These Terms of Service ("Terms") govern your access to and use of the Adullam Motors website, services, and applications. By accessing our website and using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
1. Services Provided
Adullam Motors acts primarily as a facilitator and broker between vehicle buyers and sellers in Zambia. We provide:
- An online marketplace for viewing available vehicles.
- Brokerage services to assist in the negotiation and sale of vehicles.
- Facilitation of vehicle importation, registration, and change of ownership.
We reserve the right to withdraw or amend our service, and any service or material we provide on the Website, in our sole discretion without notice.
2. Seller Obligations
If you use our platform to sell a vehicle, you warrant that you are the legal owner of the vehicle or have the explicit legal authority to sell it. Sellers must provide accurate, current, and truthful information about their vehicles, including any known defects or mechanical issues. Any intentional misrepresentation or omission of material facts may lead to the immediate removal of the listing, banning from the platform, and potential legal action.
3. Buyer Responsibilities
While Adullam Motors strives to verify the condition and legal status of all listings (especially our "Verified" listings), users are ultimately responsible for conducting their own due diligence before entering into any transaction. We strongly encourage buyers to arrange for independent mechanical inspections and to verify chassis and engine numbers against official RTSA documentation before finalizing any payments.
4. Limitation of Liability
To the fullest extent permitted by applicable law, Adullam Motors (and its parent company, Adullam Logistics Limited) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) any transactions conducted between users originating from our platform.
5. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of Zambia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
